Slingshot Rental Disclaimer & Assumption of Risk Opeski Entertainment By renting and/or operating the Slingshot vehicle (“Vehicle”), the Renter acknowledges, understands, and agrees to the following: 1. Assumption of Risk The Renter understands that operating a Slingshot vehicle involves inherent risks, including but not limited to serious bodily injury, permanent disability, property damage, or death. The Renter voluntarily assumes all risks associated with the use, operation, and possession of the Vehicle. 2. Driver Responsibility & Eligibility The Renter certifies that all drivers: Are legally licensed Are at least ___ years of age Are physically and mentally capable of operating the Vehicle The Renter agrees that no unauthorized drivers may operate the Vehicle at any time. 3. Release of Liability The Renter, on behalf of themselves, passengers, heirs, assigns, and personal representatives, releases, waives, and discharges Opeski Entertainment, its owners, members, employees, agents, and affiliates from any and all claims, demands, damages, injuries, losses, or causes of action arising out of or related to the rental, use, or operation of the Vehicle, including claims resulting from negligence. 4. Passenger Acknowledgment The Renter acknowledges that: Passengers ride at their own risk Seat belts must be worn at all times The Slingshot is an open-air vehicle and does not provide the same level of protection as a standard automobile 5. No Impairment Policy The Renter agrees not to operate the Vehicle while under the influence of alcohol, drugs, medication, or any substance that may impair driving ability. Any violation will result in immediate termination of the rental agreement with no refund. 6. Traffic Laws & Safe Operation The Renter agrees to obey all traffic laws, speed limits, and safety regulations. Reckless driving, racing, stunt driving, off-road use (unless expressly permitted), or misuse of the Vehicle is strictly prohibited. 7. Responsibility for Damages & Violations The Renter assumes full financial responsibility for: Any damage to the Vehicle Property damage Towing or impound fees Traffic tickets, citations, or violations This responsibility applies regardless of fault during the rental period. 8. Indemnification The Renter agrees to indemnify, defend, and hold harmless Opeski Entertainment from any claims, losses, damages, costs, or attorney fees arising from the Renter’s use or misuse of the Vehicle. 9. No Guarantees or Warranties The Vehicle is rented “as-is.” Opeski Entertainment makes no warranties, express or implied, regarding the condition, safety, or performance of the Vehicle. 10. Acknowledgment of Understanding The Renter confirms that they have read this agreement in full, understand all terms, and agree to them voluntarily.
